Legal Compliance & Taxes

As a seller on BitBay, you are responsible for ensuring that all your listings and transactions comply with the laws of the countries you are selling from and shipping to. You are also solely responsible for paying all taxes associated with your sales activity on our platform.

International Trading

While BitBay is a global marketplace, it is your duty to adhere to all international trade laws, sanctions, and embargoes relevant to your jurisdiction. You may not list items from regions where such restrictions apply.

Price Gouging

You may not inflate the price of essential goods in response to an emergency or disaster. All items considered essential must be offered at a reasonable price. BitBay reserves the right to restrict the sale of items susceptible to price gouging.

To protect our community, certain items are strictly prohibited or have significant restrictions. This includes, but is not limited to:

Hazardous & Recalled Materials

For the safety of our community, the following materials are strictly prohibited:

• Products recalled by a manufacturer or government agency.
• Products that pose a health or safety hazard as specified by any government agency.
• Explosives, flammable materials, radioactive materials, poisons, and corrosive substances.
• Items containing regulated substances like carcinogens or ozone-depleting substances.
• Pesticides and other harmful chemicals.

Illegal Drugs & Paraphernalia

The sale of narcotics, steroids, and other controlled substances is forbidden. The legality of such items varies by country, and sellers are responsible for adhering to all local and international laws. Any permitted items can only be sold domestically. While smoking accessories like tobacco pipes are allowed, paraphernalia intended for use with illegal substances is not.

Human Body Parts & Funeral Items

The sale of human body parts is not allowed, with the sole exception of items containing human scalp hair (e.g., wigs, lockets). Used funeral items like headstones or urns are also prohibited. New, unused funeral items may be listed.

Stolen Property & Lockpicking Devices

Listing stolen property is strictly forbidden. This includes items taken from private individuals, companies, or governments. Additionally, lockpicking devices or locksmithing tools are not allowed on the platform.

The sale of most weapons is strictly prohibited to ensure the safety of our community. This includes, but is not limited to:

Firearms & Ammunition

Firearms, ammunition, and most firearm accessories are not allowed.

Knives

Certain types of knives are prohibited, including automatic knives, butterfly knives, switchblades, push knives, and any knife that is hidden or disguised.

Other Weapons

Hand weapons (brass knuckles, nightsticks), throwing weapons with multiple sharp points, blow guns, tasers, and stun guns are generally not allowed. Pepper spray may be listed only if located in the US and shipped domestically. Stun guns may be permitted if the seller explicitly restricts sales to locations where they are legal.

Replica & Toy Firearms

Replica, toy, and prop firearms can be sold only if they have a permanently attached blaze orange barrel plug and cannot be converted to fire a lethal projectile. The listing must include a disclaimer stating its replica nature.

Military Items

Military ordnance, explosives, grenades, and items for "military use only" are forbidden. Military-issued body armor and technical manuals are also not allowed. General military surplus items (e.g., clothing, backpacks) are permitted.

BitBay is committed to being a welcoming and safe platform for all users. Therefore, content of the following nature is not permitted. This includes, but is not limited to:

Explicit & Illegal Content

• Content depicting or describing child pornography, bestiality, rape, torture, or other illegal and obscene acts is never allowed.
• Listings that promote, glorify, or are insensitive to human tragedy, suffering, or violence are prohibited.
• AI-generated or photoshopped nude or sexually suggestive images of public figures are not allowed.

Offensive Materials

Listings that promote hatred, violence, or discrimination based on race, religion, gender, sexual orientation, or other identities are forbidden. This includes items with slurs, racist portrayals, Nazi-related items (with exceptions for historical documents), and Confederate battle flags.

Adult Items

Sexually explicit materials and items displaying sexual activities are not allowed. The legality of other adult items varies by country; such listings must be marked as NSFW and can only be sold domestically where permitted. Services implying sexual activity are forbidden. Used underwear is not allowed.

Protecting Minors

Listings may not include images of minors who are not fully clothed. Using terms like "child," "teen," or "lolita" in a sexual context is strictly prohibited.

We take intellectual property rights very seriously. Listings that violate copyright or trademark laws are not allowed. This includes, but is not limited to:

Counterfeit Products

Counterfeit items, such as replica designer goods, knockoff electronics, or unauthorized reprints of media and software, are strictly illegal and prohibited. If you are not certain an item is authentic, do not list it.

Art, Artifacts & Antiquities

Listings for art and artifacts must be transparent about authenticity. Any claims must be backed by evidence (like a COA or provenance) provided to the buyer. Reproductions must be clearly labeled as such in the title and description. You may not use an artist's name to describe a work "in the style of" that artist. Stolen or looted cultural goods are forbidden.

Collectible Currency, Stamps & Bullion

Counterfeit currency, stamps, and bullion are not allowed. Listings must accurately describe the item's condition, purity, and grade. Graded currency must be from an approved company. Replicas must be clearly marked as such.

Custom Printed Products

Custom printed items are allowed only if they do not include unauthorized third-party content, such as copyrighted images, logos, or pictures of individuals used without consent.

Due to health, safety, and regulatory reasons, the following organic and food-related items are subject to specific rules. This includes, but is not limited to:

Live Animals & Animal Products

The sale of live animals is not allowed. Additionally, items made from endangered or protected species (e.g., ivory, certain whale bones) are prohibited. Animal traps must specify their size, and certain types like bear traps are forbidden.

Plants & Seeds

The sale of plants and seeds is not permitted due to complex international and local regulations.

Food, Alcohol & Tobacco

Sellers listing food items must ensure they are properly packaged, stored, and delivered before the clearly stated expiration date. Certain items like unpasteurized dairy are not allowed. For alcohol and tobacco, sales are subject to country-specific laws; where permitted, both buyer and seller must meet the legal age requirement (e.g., 21+ for alcohol) and sales must be domestic.

The sale of digital and intangible items is subject to specific rules to prevent fraud and ensure clarity for buyers. This includes, but is not limited to:

Electronically Delivered Items

Digital items like software keys or movie codes are allowed only if the seller is authorized to sell them. For codes included with a physical purchase (like a Blu-ray), the original physical item must be included in the sale.

Beta & OEM Software

Beta software, keys, or access codes are not allowed. OEM or bundled software must be sold with the original hardware it was included with.

Virtual Currency

Mining contracts for virtual currency are not permitted.

Intangible Items & Prohibited Services

Items that a buyer cannot confirm receipt of, such as a "ghost in a jar" or a magic spell, are not allowed. Prohibited services include personal relationships, dating or escort services, get-rich-quick schemes, and services that manipulate social media or online reviews.

Certain goods are subject to government regulations or pose a higher risk, and their sale is restricted on our platform. This includes, but is not limited to:

Medical Devices & Drugs

Any medical device that requires a prescription (e.g., CPAP machines, prescription hearing aids) cannot be sold. Needles are also prohibited. Over-the-counter devices and new, unused syringes are permitted. Prescription and over-the-counter drugs are subject to country-specific laws and must be sold domestically where allowed and marked as NSFW.

Cosmetics & Perfumes

Used cosmetics, counterfeit perfumes, or products not in their original packaging are not allowed.

Vehicles, Parts & Accessories

Vehicles can be listed if they have a valid VIN. Certain parts are restricted, especially those designed to bypass or defeat emissions control systems. Deployed or recalled airbags are strictly forbidden.

Event Tickets & Gift Cards

Ticket resales must comply with all local laws. Gift cards must be valid and have their value clearly stated; expired or store credit receipts are not allowed.

Chance Listings & Slot Machines

Lottery tickets and raffles are not allowed. Mystery boxes are permitted if they contain general information about the contents. Functional slot machines can only be sold where legal.
